Intellectual Property Policy
1. What do we understand by “Intellectual Property”?
The World Intellectual Property Organization (WIPO), defines Intellectual Property as related “with the creations of the mind: inventions, literary and artistic works, as well as symbols and names and images used in commerce”. In short, Intellectual Property is all creation of the human intellect.
In Spain, the Ministry of Education, Culture and Sport states that “intellectual property is the set of rights that correspond to the authors and other owners (artists, producers, broadcasting organizations, etc.) regarding works and services resulting from their creation.”
Once the definition of Intellectual Property has been clarified, let’s see the areas in which it is divided:
a) On the one hand, we have industrial property, which includes patents for inventions, trademarks, industrial designs and geographical indications.
b) On the other hand, we have copyright, including literary works, films, musical works, artistic works, and architectural designs. Copyrights include so-called neighboring rights that include the rights of performers regarding their performances, those of producers of phonograms and those of broadcasting organizations regarding their radio and television programs.
2. Purpose of this Policy
The purpose of this Policy is to reaffirm Wiseplay’s respect for intellectual property rights.
Wiseplay will respond expeditiously to the communications of irregularities in relation to the copyright that is committed during the use of its services. In addition, and in accordance with the applicable legislation, Wiseplay reserves the right, in its sole discretion, to report any conduct that may involve a real and obvious violation of copyright.
3. The complaints channel
In order to prevent and detect any irregular conduct with respect to the intellectual property rights of a third party, Wiseplay has a complaints channel (firstname.lastname@example.org) accessible to all users of the application.
The reality shows that a channel of complaints is the first source for an organization to know the existence of irregularities committed within it.
In this context, Wiseplay is obliged to maintain a channel of complaints of transparent nature that allows any third party to reveal any ethical concern, and to communicate, confidentially, any irregular conduct that supposes the breach of the Wiseplay Code of Conduct.
